Your family relationship needs the correct residence route.
Relatives of Spanish citizens have a specific residence regime in force since 20 May 2025. Changes in 2026 expanded certain applications from Spain and regulated provisional residence and work. This route is different from general family reunification and the EU-citizen family card.

Subject to their own conditions, categories include spouses, registered or qualifying stable partners, certain children, ascendants, parents of Spanish minors, a qualifying family carer, children of Spaniards by origin and other dependent relatives. For children the reference is under 26, with additional rules for dependent adults, disability and separate family units. Ascendants require an individual dependency, support or humanitarian assessment. Kinship alone is not enough.
Prepare EX-24, the Spanish relative’s identity document, the applicant’s passport and evidence of the relationship and living together or joining the family. Add any required dependency, care or parental-responsibility evidence. For an unregistered stable partnership the rule refers to at least 12 months of comparable cohabitation, except where there are common descendants and the relationship continues. Do not apply the general reunification income formula automatically.
Under article 97.1.c, when both are in Spain, relatives in article 94.1.a–h may use that route; category i has its own treatment. After admission to processing, article 97.5 permits provisional residence and, at working age, employee or self-employed work, subject to its conditions and exclusions. Check the communication recording that entitlement: marriage or an ordinary filing receipt alone does not establish it.
The ordinary decision period is two months, with negative administrative silence. The residence authorisation is exempt from its application fee, which does not make the separate TIE fee free. The permit is generally five years or the intended shorter period of residence. Changes in the relationship may require notification or assessment of independent residence. The Supreme Court’s 2026 ruling rejects automatic criminal-record refusal without individual assessment in situations covered by article 20 TFEU; it does not abolish all criminal-record requirements.
No. Other-dependent-relative cases have specific conditions; a birth certificate proving kinship is insufficient by itself.
Marriage alone does not replace a qualifying authorisation or the applicable provisional entitlement after admission.
