Provider and professional identity
Víctor José Burgos Valenciano, individual professional; NIF 04614439H. Trading name: Pérez & Burgos Abogados, not a company. Professional and tax address: Calle Fresadores, 1, 1.º J, 29640 Fuengirola, Málaga, Spain. Contact: contacto@perezburgosabogados.es. Practising lawyer, Málaga Bar no. 11.275; Spanish law degree and university master’s in access to the legal profession from Universidad de Castilla-La Mancha. The activity is legal services, legal practice and mediation in Spain.
Electronic contracts and invoices issued through this website correspond to that provider. Estefanía Pérez Palma, practising lawyer, Málaga Bar no. 11.274, co-directs the firm. Where appropriate other lawyers, court representatives, experts or collaborators may intervene; the client is informed of identity, role and applicable scope before an intervention affecting the engagement. The trading name does not replace the professional identified in an engagement letter.
Mediation
Both co-directors have specific training and civil-liability cover for mediation. Víctor is entered in the Ministry of Justice Register of Mediators and Mediation Institutions and mainly handles general, civil and commercial mediation; Estefanía specialises in family mediation. A mediator acts neutrally and impartially, does not represent or advise one party individually and does not impose a solution. Starting requires party agreement, conflict checks and the corresponding documents.
Website use and legal information
Use the site lawfully, provide accurate information and do not damage or alter its content or systems. Website content, including Calma AI orientation, is general information rather than individual legal advice. A form or email alone does not confirm an appointment, create an engagement or start mediation. A paid consultation is contracted on payment and confirmation; free assessments require appointment confirmation. Further work requires an agreed scope and professional documentation.
Spanish law, the General Statute and Ethics Code of the Spanish Legal Profession, Málaga Bar rules and, for mediation, Law 5/2012 and implementing rules apply. Content and visual identity belong to the holder or are used with permission; unauthorised exploitation outside legal exceptions is prohibited. External references have their own content and policies. Reasonable maintenance measures do not guarantee complete freedom from error or interruption.
Fees and scope
The first labour consultation is free for up to 15 minutes of initial orientation on one matter. The full labour consultation with document review is 49,90 € VAT included. Other matters cost 49,90 € without document review or 121 € with document review, VAT included. Unusually extensive or complex documents may need an additional quote, accepted before that work.
These consultations exclude drafting, management, negotiation, representation, court representatives, experts, later defence and mediation unless expressly included. Ordinary accounting, invoicing or return-filing information requests do not require a paid legal consultation first. Initial traffic and Spain–Italy assessments have their own published free conditions. Mediation fees and any additional work are explained before acceptance.
Data controller
The controller is Víctor José Burgos Valenciano, with the identity, address and email stated above. No data-protection officer has been appointed. Direct privacy enquiries to contacto@perezburgosabogados.es.
Processing purposes and legal bases
Contact requests: identity, contact details and a general case description are used to respond and consider a possible consultation, on requested pre-contractual measures. Accounting and invoicing requests may also include province, activity, profile, requested management, approximate volume, staff and next deadline to prepare an internal file and appropriate proposal, on that same basis.
Contract and payment: identity, contact, selected service, preliminary case details, acceptance, payment reference and billing data are processed to contract, organise assistance, charge and prove the transaction, based on contract performance and legal, tax and accounting duties. Minimal session entry page, source and campaign may measure channels producing contracts on legitimate interest, without reconstructing browsing history.
Legal documents and communications: necessary case files and data are processed for contract performance, professional duties and establishment, exercise or defence of claims; special categories are processed under GDPR article 9(2)(f) where applicable. Mediation also involves party identity, conflict checks and necessary communications, based on pre-contract measures, the mediation agreement, legal obligations and, where required, explicit consent or legal claims for special categories.
Professional applications: identity, contact, Bar membership, experience and certificates are used to consider requested collaboration on pre-contractual measures and consent for voluntary additional information. Internal measurement uses aggregate page/action counts, route, referrer domain, campaign, language, device category and country when hosting supplies it, on legitimate interest with minimisation. It retains no IP address, browser fingerprint or visitor identifier. Minimal technical security logs prevent abuse, fraud and unauthorised access, based on legitimate interest and security duties.
Required data and confidentiality
Marked fields are necessary for the request or contract; other fields are optional. Do not provide third-party data unless necessary, lawful and accompanied by the required information. The first form should contain only a general description and relevant deadlines. Do not send full files, identity documents, health records, passwords or bank information through an initial form or email.
After payment, use the private portal for relevant documents. Health, union-membership or other special-category data required for a legal matter are processed under professional secrecy where necessary for legal claims. The chosen language helps organise contact; it does not promise that a particular lawyer speaks that language.
Retention
Requests not leading to a contract: up to 12 months from last interaction unless responsibilities require longer. Uncontracted internal accounting or invoicing requests: up to six months unless earlier deletion is requested or retention is legally required. Abandoned pre-payment contract requests: up to 48 hours.
Contract, payment evidence and related communications: during the relationship and applicable limitation periods. Invoices and financial documents: required tax, accounting and commercial periods. Professional files: throughout the engagement and applicable legal, ethical and liability periods afterwards. Documents for a consultation not followed by an engagement are reviewed for deletion after it ends, ordinarily within 90 days, unless legal obligations or claims require retention. Unsuccessful professional applications: at most 12 months unless earlier deletion or a later relationship applies. Aggregate measurement: at most 13 months. Any legally retained data are restricted to that purpose.
Recipients and international transfers
Data are not sold. Necessary hosting, email and support providers may access data under processing agreements. Stripe processes payments and billing; the firm does not receive complete card details. Calma AI is a separate service and does not automatically receive the firm’s form data.
Ordinary accounting, invoicing or tax-form requests through the assistant initially stay in an internal queue and are not automatically forwarded to an outside manager, collaborator or platform. Any later transfer to a separate controller requires prior information on identity, purpose and conditions and any necessary authorisation. Data may reach courts, administrations, court representatives, experts or other professionals where necessary, legally required or disclosed to the client. For technology processing outside the EEA, adequacy decisions, the EU–US Data Privacy Framework where applicable or standard contractual clauses and supplementary safeguards are used.
WhatsApp is optional and opens an external service governed by its own privacy policy. Use it for contact arrangements, not to send sensitive documents or passwords. Email and the firm’s form remain alternatives. Visiting the website does not load a WhatsApp chat or its technology.
Automated decisions and rights
There are no solely automated decisions with legal effects or client/candidate profiling. Calma AI does not decide acceptance, strategy or outcome.
Request access, rectification, erasure, objection, restriction or portability, or withdraw consent where it is the basis, by email to contacto@perezburgosabogados.es. Identify the right you wish to exercise; extra identity evidence is requested only when necessary. You may also complain to the Spanish Data Protection Agency, AEPD.
Only necessary cookies
The website uses no advertising, profiling or third-party analytics cookies. Temporary technical cookies protect contact forms (pb_contact), contracting (pb_payment), professional applications (pb_candidate) and authenticated professional administration (pb_admin, private area only). Their duration is the session.
Own measurement is cookieless and aggregate by day. Session storage in the current tab remembers the initial page, source and campaign only to attach them to a resulting contract; it ends with the browser session and contains no personal identifier. There is no retained IP, fingerprint or cross-visit tracking ID. This limited measurement does not build individual profiles; no identification/tracking consent panel is shown. Any future non-essential technology must be blocked until a valid choice.
Complaints
Write to the contact email or postal address, identifying contact details, affected service, facts and requested solution. The firm acknowledges receipt and responds within the applicable legal period. Official Junta de Andalucía complaint forms are available through HOJ@ and legally permitted channels. Professional-ethics complaints may also be addressed to the Málaga Bar where appropriate.
