Arraigo in Spain: which residence route fits your situation?

Choose the route your facts can support.

The five ordinary arraigo routes are not interchangeable. Residence history, previous permits, family ties, work, training and financial means determine the appropriate route. Two years on the municipal register alone do not prove eligibility.

You can send your request in English. We will confirm the language and arrangements for professional assistance before accepting an engagement.

Five routes, different evidence

Arraigo sociolaboral relies on qualifying employment contracts; social arraigo on the relevant family or integration conditions and means; socioformativo on eligible training and integration. Second-opportunity arraigo concerns certain previous residence permits. Family arraigo has specific qualifying family situations and must not be confused with the separate permit for relatives of Spanish citizens.

Common conditions and the two-year rule

Except for family arraigo, at least two years of qualifying continuous presence are required. Under article 126.b, time while an international-protection application is pending until a final administrative and, where applicable, judicial decision does not count. International-protection status, criminal records, entry restrictions, public order and any commitment not to return must also be checked. Article 126.h, introduced in April 2026, excludes holders of a stay or residence authorisation and people with an authorisation, extension, renewal or modification procedure pending.

Prepare a complete chronology

Keep evidence of entry, absences, municipal registration, asylum proceedings and previous decisions. Administrative guidance generally permits absences of no more than 90 days over the two-year period, but the chronology and supporting evidence still need review. Do not withdraw a pending application automatically: assess the protection or alternatives you would lose first.

Filing and the right to work

Ordinary duration is one year, except family arraigo, which is five years. The provisional work authorisation introduced for sociolaboral arraigo depends on admission and the communication opening processing; it is not a general effect of filing any arraigo. The usual form is EX-10. The ordinary decision period is three months, with negative administrative silence; this is not a promise of actual processing speed.

Frequently asked questions

Does having a Spanish child mean I must wait two years?

Not necessarily. A relative-of-a-Spanish-citizen permit may be the relevant route instead.

Is the old arraigo laboral a sixth current ordinary route?

No. Earlier cases and transitional rules require identifying the applicable legislation.
