Renewing a residence and work permit in Spain

Start with the permit and its expiry date.

Renewing an ordinary residence permit for work as an employee is different from extending student status, renewing non-lucrative residence or documenting long-term residence. Identify the decision granting your permit and its legal basis before using a deadline calculator.

You can send your request in English. We will confirm the language and arrangements for professional assistance before accepting an engagement.

Two calendar months before and three after

Article 80 allows filing during the two months before expiry. It also provides a three-month window after expiry, without excluding possible sanction proceedings for late filing. These are calendar months, not interchangeable with 60 and 90 days. Filing within the statutory windows extends the previous authorisation until the decision. Keep the complete filing receipt.

Losing your job does not answer the whole question

Continuing in the original job is one renewal route, not the only one. Article 80 also provides conditional alternatives involving previous work and a new contract, involuntary termination with continuous jobseeker registration, benefits, family resources and certain protected situations. Three months worked alone do not guarantee renewal; each alternative has cumulative conditions and evidence.

Evidence to organise

Gather the permit decision, current and previous passport where relevant, TIE, employment history, contracts, payslips and evidence of why employment ended. If relying on a benefit, jobseeker registration or a family member’s means, document that specific route. Compulsory schooling of dependent children and any applicable integration evidence must be addressed. Criminal records require the renewal-specific assessment.

While you wait and if a decision arrives

The ordinary decision period is three months with positive administrative silence in this particular renewal procedure. Establish when the competent body received the file and any valid suspension or request for documents before relying on silence. Do not apply this rule to student extensions or initial permits. A receipt is not proof of a favourable decision; travel may require an authorisation to return. If refused, keep the complete decision and proof of notification and check appeal deadlines immediately.

Frequently asked questions

Can I use the expiry date on any TIE?

No. First identify the underlying authorisation and whether renewal or modification is appropriate.

Does the late-filing window mean there is no sanction risk?

No. Article 80 preserves possible sanction proceedings even where filing extends the prior authorisation.
