Immigration notifications in Spain: DEHú and deadlines

The legal notification date matters more than the email reminder.

Obtain the complete notice and its notification records. The date it becomes available, the date it is opened and the date shown on the online case-status screen can differ. These differences can determine when you must reply or appeal.

You can send your request in English. We will confirm the language and arrangements for professional assistance before accepting an engagement.

Locate the official notice

Use DEHú or the authority's official electronic office, as applicable. An online status or email reminder is not the complete decision. Download every page and attachment, plus the records of availability and access or rejection. If an authorised representative received it, confirm who accessed it and when. Keep the original file and verification code.

Ten days to access is not ten extra days to respond

Electronic notification is generally made when its content is accessed. Where electronic notification is mandatory or was expressly chosen, ten calendar days without access after it is made available result in deemed rejection under Article 43 of Law 39/2015. This concerns receipt of the notice; it is not itself a new refusal of the immigration application. Calendar days include weekends. Do not add a new ten-day access period to a reply or appeal deadline, or assume that a later visit to another portal starts the clock again.

If access fails or a file will not open

Keep complete screenshots, dates, times, error messages and the official support reference if provided. Check your identification method, its validity and any representation. Never send the firm passwords or one-time login codes. A technical incident does not automatically stop deadlines: evidence the problem and check any officially adopted extension or other applicable legal effect. If time is short, seek legal help without waiting for support to resolve it.

Prepare a short timeline

List availability, first access, any receipt by your representative and failed access attempts. Add the notice, original application and previous replies. If only a status saying unfavourable is available, obtain the decision promptly. An informal complaint, phone call or request for a file copy does not by itself preserve an appeal deadline.

Useful questions

I received no text message. Can the notification still be valid?

Yes. A reminder and a legal notification perform different functions. Lack of an email or SMS reminder does not by itself invalidate notification. Check the complete record and the channel used.

Can I gain time by leaving it unopened?

Do not rely on that. The ten-calendar-day deemed-rejection rule can apply when electronic notification is mandatory or expressly chosen. Opening later does not necessarily undo its legal effects.

What date should I give the lawyer?

All relevant dates, not just the one you consider favourable: availability, access or rejection, receipt by a representative and any later copies. Provide the corresponding records so the effective notification and deadline can be checked.
